INCREASING TRENDS OF TRADE SECRETS, ARTIFICIAL INTELLIGENCE AND PRIVACY LAWS IN INDIA: A BIRD’S EYE VIEW

ABSTRACT

Trade Secrets are considered to be the backbone of any business. The economic value of such information can never be quantified owing to is confidential nature which carries efficacy of enhancing the business not only financially but even organizationally. Indian Laws on Trade Secrets are jurisprudentially developing with the decisions of different courts. The privacy that needs to be maintained to confer the status of ‘trade secret’ to any information is governed by the developing law of the nation ensuring privacy to its subjects. A threat may be caused to privacy of trade secret by the advancement of Artificial Intelligence, which though may not have the identical capabilities as of human intelligence, which may be a utilized as an instrument to achieve the know-how of the competing business. This Paper attempts to identify the protection accorded to trade secrets in India, the implications of advanced privacy laws and the advent of artificial intelligence on the trade secrets.

THE WASTE LAND AS FERTILE LAND FOR ENGLISH LITERATURE

ABSTRACT

Encompassing the period of Modernist movement, Eliot's The Wasteland Land is perhaps a prime example of realistic study of the world and its society brimming with complex subject matters and experimentation in poetic technique. One of the longest poems, written with 434 lines and five sections, the poem serves as a great inspiration to many modernist as well as post-modernist writers. The fragmentary nature of time, the hollowness and meaninglessness of lives, ravages caused by the world war, violation of sex through the degeneration of love into lust are responsible for the spiritual drought in the modern wasteland. The beauty of the work lies in the fact that the poem effortlessly blends the past and the present; the East and the West. This study examines how the ideas manifested in the The Wasteland are relevant in the present world.

COVID 19 has totally become huge loss for this entire world and it's also caused a huge loss to each and every Industry. In this situation most of the industries are being closed and it has running in a huge loss. Like other industries and sectors Hotel industry has also being closed since the beginning of this pandemic and it has totally running a huge loss in revenue. As hotel industry is totally dependent on Accommodation and Food and it's totally closed due to no availability of Guests. Kolkata which is known as City of Joy and which is totally famous for its own delicacies and also the delicacies from various regions and for this every hotel of Kolkata use to have a huge profit of business each and every particular day before this pandemic. Kolkata also have other sectors like IT sectors, banking sectors, hospitals, Corporate sectors, financial sectors etc and these sectors are having top corporate delegates who all are almost preferable to have their conferences, meetings, seminars in top class hotels, not only that many other companies also have their tie up with various foreign companies and for them mostly they are interested to dine in top class hotels in Kolkata. For this the hotels of Kolkata is use to earn a huge amount of revenue in each and every particular day. But in this pandemic situation as the hotels and other companies are totally closed in this so it is running in a huge loss since beginning of this pandemic. Many hotels of Kolkata for having no guests is this situation is totally running in a huge loss. The revenue which was running cores per day is running either zero or is running in a very little which is totally a loss in the business. Hotels of Kolkata for not having guests is bound to closed the inter departments also and for this lots and lots of staffs have lost their jobs. Not only that our hotel industry is mostly dependable on Tourism industry and as this industry is also not going properly for these reason hotels in Kolkata is running in a great loss. Hotel industry in this situation has got mostly got effected and loss in revenue and till date it is going and it is needed to be overcome after this pandemic is overwhelmed

CASTE STRUGGLE AND CASTE ABUSES IN DOWNTRODDEN LIFE (WITH SPECIAL REFERENCE TO OMPRAKASH VALMIKI’S JOOTHAN)

ABSTRACT

Downtrodden Life strongly articulates burdened status in   Indian social system. Indian higher caste society use to tell Indian downtrodden as a Dalit. Etymologically ‘Dalit’ word comes from Sanskrit root word ‘dal’, which means in Hindi ‘Dal’ it means in English to crack open, to spilt, to crush, to grind. It has generally been using as a verb to describe the process of processing food grains and lentils. It’s symbolic usage; still as a verb and it has been seen in descriptions of conflict and conquering of opponents. Maharashtrian social reformist Mahatma Jotirao Phule and Indian Constitution architect Dr. B. R. Ambedkar are the two towering figures in the pantheon of Dalit history, have been remained as the first social campaigner in the early decades of  twentieth century to define the extreme oppression of untouchables such; as suffering, frustrations, expectations and groaning of the entire cosmos. The name donated by Gandhji with an apparent goodwill had been used the specific word for downtrodden such as; Harijan which evoked the people of God but on the real ground downtrodden had been surviving the discomfort and conflict life in Indian caste hierarchical social system. To look upon downtrodden Indian higher caste people have been using the various names and labels as a state wise and region wise to describe the untouchable communities all over India such as; Achut, Pannchamas, Shudra, Atishudra, Avarnas, Antyajas, Asparshyas, Pariah and etc. Apart from this, Indian government assigned the designation to downtrodden such as; the Depressed Castes, Scheduled Castes, Schedule Tribe, Nomadic Tribe and Other Backward Castes. By identifying as Downtrodden, Omprakash Valmiki defines them, as an identity that is born in a historic struggle to dismantle the caste system, responsible for their untouchable status, and to rebuild society on the principles of human dignity, equality and respect. The identity of caste as one of the central questions to underlines the dominance of higher caste Hindu point of view in all walks of Indian life, whether it is literary expression, education and political governance.

RIGHT TO ACCESS AFFORDABLE AND EFFECTIVE MEDICINES IN THE WORLD OF PATENTS AND PANDEMICS WITH REFERENCE TO INDIA

ABSTRACT

Pharmaceutical Drug research and development is an expensive, time consuming and uncertain process that may take 8-10 years to complete. Patent watch begins much before a new drug is approved for marketing and significant amount of time can be lost in the review and approval process by regulatory bodies. So to regain the considerable time and resources invested in the drug development and approval process the pharmaceutical companies depend on exclusivity provisions granted by the regulatory bodies. There are several official and unofficial methods to extend term of a patent beyond 20 years, Official methods include provisions by some regulatory bodies such as Data exclusivity, Orphan drug exclusivity, Pediatric exclusivity and the 180-day exclusivity for first generic company after the expiration of patent in American Hatch Waxman Act, 1984 or Supplementary protection certificate given by European Medical Agency. Unsanctioned methods include altering or reformulate the existing compound to obtain a new patent by creating combinations, taking advantage of polymorphism, authorized generics, etc. In the era of big pharmaceuticals dominating and promoting their drugs through international conventions and important national persons, it is very difficult to assume that states really want to promote affordable and effective drugs for patients globally. Despite being there explicitly in Article 25 and Article 27 of  Universal Declaration of Human Rights, 1948 and in Article 12 of International Convention on Economic, Social and Cultural Rights, 1966, people have not been able to fully enjoy and exercise their rights regarding health. In fact, the world needs to think seriously about World Health Organization’s approach to health crisis globally after their approach to Corona virus scare globally and their bipartisan attitude towards China.  We need to look also weather international law is applicable actually or is it mere paper work exercise. The world needs to make fine balance between research and development of new drugs and their quality and price also. Despite efforts from various organizations from different countries and different people, it has not been achieved fully. We should not forget that it was Hamid Yusuf and his Indian Company Cipla which came into aid of world with 38 cent per day therapy for epidemic called acquired immunodeficiency syndrome (AIDS).
